Protecting Minors
It is against UK law to sell or supply intoxicating substances to persons under 18 years of age. People buying from the site must confirm that they are 18 years of age or older.
Prices
All prices are in pounds UK Sterling and include VAT and duty.
Law
All contracts are governed by English law and jurisdiction.
Force Majeure
The company will not be liable for failure to meet agreed obligations due to prevailing circumstances beyond its reasonable control.
Claims
Deliveries should be carefully inspected at the time of delivery. Any omissions or breakages should be noted on the delivery note before signing. Please notify us immediately of any breakages or wine shortages. We are unable to guarantee credit or replacements unless we are notified within 3 days of delivery of the order. Please be aware that multi-case orders can become separated. If you do not receive the balance of your order within 3 working days of the first delivery please contact us. Standard UK deliveries should always arrive within 3 working days of the date of order. So far as the law permits however the company shall not be liable for consequential loss or damage in any respect of an order not being delivered correctly or on time.
Ownership
All wines and spirits or other goods ordered remain the property of Cardinal Online Ventures Ltd (owner of The Cardinal's Cellar) or its associates until payment is received in full.
Return of Goods/Cancellation
Orders for goods to be delivered may be cancelled within 7 working days of receipt of goods. A full refund will be offered provided the goods remain in good condition and that the request to cancel is received in writing. Any cancelled order will be refunded within 30 days. A charge of £10 for collections will be payable. If returned wines are not deemed to be in a saleable condition, a re-delivery fee will also be charged and no refund will be offered. We regret that The Cardinal’s Cellar cannot offer refunds on opened bottles of wine. It should be remembered that all wines and their corks are subject to natural processes that, however well cared for, can affect the quality of the wine – particularly for the older fine wines which we tend to sell. This may mean that a small percentage of bottles sold by us are not of optimum quality. No liability will be accepted for this.
Description & Prices
The description and prices payable for the items you order are clearly set out on our website. If, by mistake, we have under-priced an item, we will not be liable to provide that item to you at the stated price provided that we notify you before we dispatch the item concerned. In the unlikely event that an item has been over charged a full refund of the difference will be given. Prices listed for wines are quoted per bottle and include VAT at 20%. Prices are subject to changes in duty and VAT.
Data Protection
The Cardinal’s Cellar undertakes to discharge its duties under current legislation.
We use your information to administer, support, improve and obtain feedback on our services and to detect and prevent faults, breaches of our network security, the law or our contract terms. If you have used our service we may contact you to obtain feedback on that service and any improvements we could make to it. You have a right to ask us at any time not to contact you by way of direct marketing. You can do this by contacting us by email at the following address - enquiries@thecardinalscellar.com - with the words ‘Stop Contact’ in the subject line.
The cardinal's cellar collects and updates information about users of its services. It may obtain this information via direct contact with you, from third parties such as other users and automatically via your use of our services. This information may include your contact details, payment details, support problems, survey responses and certain relevant details of your preferences. The Cardinal's Cellar also gathers information about your use of our services such as generic types of data accessed, times and volumes of use of the service and traffic data from the use of our website. Traffic data includes logs, details of networks, data and systems accessed, details of the sender and recipients of messages sent over our services, times and location of log on or access, duration of sessions, clickstream and similar usage or system data. Upon request we can provide site visitors with access to all information including proprietary information that we maintain about them specifically including contact information. Users can access this information by writing or emailing us. Upon request we offer visitors the ability to have inaccuracies corrected by providing such correct details to The Cardinal’s Cellar’s registered address.
The information we collect is used primarily for internal review and to improve the content of our Website & services. It is also used to notify users about updates to our services. This information is not shared with other organisations for commercial purposes. We do not share or sell our customer list to any third party. If you supply us with your postal address or telephone number you may receive periodic mailings or calls from us with information on new products and services or upcoming events. The security of your Personal Information is important to us. We are aware of generally accepted industry standards to protect Personal Information. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security. For your security, The Cardinal's Cellar uses Sage Pay's highly sophisticated encryption systems to take all credit and debit card payments. Credit or debit card details are not held on The Cardinal's Cellar's servers.
Duty & VAT
All wines on sale at the thecardinalscellar.com are VAT inclusive and are duty paid.
Delivery Charges & Policy
As long as the value of your order is £250 (incl VAT) or more, we'll pick up the cost of courier delivery within the mainland UK. For smaller orders, we charge a flat rate of £7.50. Delivery is by courier and your order should be with you within 3 working days (or less). We do not use Royal Mail for any of our deliveries so they will be unaffected by occasional Royal Mail strike action. Delivery is within three working days to mainland UK addresses. All orders regardless of value, for delivery beyond UK mainland, are subject to a surcharge. A quote will be supplied on request.
If you are not home when our carrier attempts delivery, they will leave a card giving a contact number which you may use to re-arrange the delivery, however they will attempt a second time. Alternatively, collection from the depot can be arranged; the consignment will be held for a short time before being returned to The Cardinal’s Cellar. The Cardinal’s Cellar has authorised our carriers to deliver only when a signature for receipt is obtainable. We regret that once an order has been processed, we are unable to change any delivery information.
Limited liability
The Cardinal’s Cellar accepts no liability for their actions beyond those stipulated under relevant sections of the Sale of Goods Acts and Distance Selling Regulations. Whilst The Cardinal’s Cellar will take every reasonable care to supply wines they believe to be drinkable and of good quality, it should be remembered that all wines and their corks are subject to natural processes which, however well cared for, can affect the quality of the wine. No liability will be accepted for any deterioration encountered in our wines prior to sale.
